1. Agreement to Terms

By accessing or using any software, services, or websites provided by Random Llama Software, LLC ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you do not have permission to access our services.

2. License Grant

Software License

Upon purchase, we grant you a non-exclusive, non-transferable license to use our software products according to the license type purchased:

• Single License: Installation and use on one (1) computer
• Team/Pro License: Installation and use on the specified number of computers
• Subscription License: Use during the active subscription period only

Restrictions

You may not:

• Modify, reverse engineer, or decompile the software
• Redistribute, sell, or share license keys
• Use the software for illegal purposes
• Remove or alter any proprietary notices
• Use one license on more devices than permitted

3. Purchases and Refunds

Payment Terms

• All prices are in US Dollars unless otherwise specified
• Payment is due at the time of purchase
• We accept payment via Stripe (credit/debit cards)
• Prices may change at any time without notice

Refund Policy

We offer a 30-day money-back guarantee on all software purchases. To request a refund:

• Contact us within 30 days of purchase
• Provide your order number and reason for refund
• Uninstall the software from all devices

Refunds are not available for custom development services once work has begun.

4. Intellectual Property

All software, content, and materials available through our services are the property of Random Llama Software, LLC and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.

5. User Obligations

You agree to:

• Provide accurate information when purchasing licenses
• Keep your license keys confidential
• Use the software in compliance with all applicable laws
• Not attempt to circumvent license restrictions
• Report any bugs or security vulnerabilities responsibly

6. Warranties and Disclaimers

Limited Warranty

We warrant that our software will perform substantially in accordance with the documentation for a period of 90 days from purchase. If you report a defect during this period, we will either fix the issue or provide a refund at our discretion.

EXCEPT AS EXPRESSLY PROVIDED ABOVE, THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

7. Limitation of Liability

IN NO EVENT SHALL RANDOM LLAMA SOFTWARE, LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES. OUR AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SOFTWARE OR SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

8. Indemnification

You agree to indemnify, defend, and hold harmless Random Llama Software, LLC, its officers, directors, employees, agents, and suppliers from any claim, demand, damages, or other losses, including reasonable attorneys' fees, asserted by any third party due to or arising out of your use of the software or violation of these Terms.

9. Termination

We may terminate or suspend your license immediately, without prior notice or liability, for any reason, including:

• Breach of these Terms
• Fraudulent or illegal activity
• Non-payment (for subscription services)
• Distribution of license keys or pirated software

Upon termination, you must cease all use of the software and destroy all copies.

10. Updates and Support

• Updates are included for the period specified with your license
• After the update period expires, the software continues to work but won't receive updates
• Support is provided via email during business hours (CST)
• We do not guarantee compatibility with all systems or configurations

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Texas, United States, without regard to its conflict of law provisions. Any legal action or proceeding shall be brought exclusively in the courts located in Fort Bend County, Texas.

12. Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

13. Export Compliance

You may not use or export our software in violation of U.S. export laws and regulations. By using our software, you represent that you are not located in a country subject to a U.S. government embargo or designated as a "terrorist supporting" country.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect. By continuing to use our software after revisions become effective, you agree to be bound by the revised terms.
